The terms, in plain words

What you are buying, what it is not, what it costs, how it arrives, what your rights are and how to get your money back if it is not right: short enough to read before you pay.

General information · not legal advice · not a law firm.

Who you are buying from

The Family Handover Kit is sold by Joel Patterson, a sole trader in the United Kingdom trading as Standard Index Group and as Valoren. In these terms, "we" means that business.

Business address: 128 Blindmans Lane, Cheshunt, Waltham Cross EN8 9DN, United Kingdom

Email: hello@familyhandoverkit.com

Phone: +44 20 3996 2682 (a United Kingdom number; a message left there reaches us by email)

We have no office in Australia. We are not an Australian law firm, and nothing we sell is legal advice.

What you buy

One Family Handover Kit, Australian edition, for the state you choose: New South Wales, Victoria or Queensland.

It comes as two PDF files, emailed to the address you give: one laid out to print, and one with fields you can type into. Both are prepared from the answers you type into the order form, together with general information for your state that we read from official bodies and date.

Your answers are printed as you gave them. Only two of them change what else is printed: your state, and the organisations you name, each of which adds its own row and the address of its own published page.

What it is not

The Kit is general information and your own record. It is not legal advice, and no lawyer has looked at your answers or your situation. It does not decide anything for your household: not who inherits, not whether a grant of probate or letters of administration is needed, not whether a will or a power of attorney is valid or what it does.

Every fact in it is printed as the body that publishes it stated it on the date shown, and facts change. It prepares no letters. The order form asks for no medical information: please do not type medical details into any answer. For your own situation, speak to a solicitor or to the organisation concerned.

Price and payment

The price is A$59, in Australian dollars, paid once by card through Stripe. There is no subscription, no renewal and nothing to add. A$59 is the total price: no GST is charged, because we are not registered for GST in Australia, and your receipt is not a tax invoice.

Who can buy

We sell the Kit to buyers in New South Wales, Victoria and Queensland. An order for any other state or territory is refused before payment, and the same check runs again before a Kit is prepared. If a payment were ever taken for a state we do not cover, we refund it in full.

Delivery

Your Kit is prepared and emailed within minutes of payment. If anything stops it being prepared, it is held and a person looks at it, and you hear from us by email; nothing is sent incomplete. If it has not arrived within an hour, check your spam folder, then email us.

Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Nothing in these terms takes away or limits those rights.

Our 30-day money-back promise

This promise is given by Joel Patterson, trading as Standard Index Group and Valoren, of 128 Blindmans Lane, Cheshunt, Waltham Cross EN8 9DN, United Kingdom, phone +44 20 3996 2682, email hello@familyhandoverkit.com.

What we promise

If, within 30 days of the day your Kit is emailed to you, you tell us that it is not right or that you do not want it, we refund the A$59 in full to the card you paid with. No reason is needed. If something in the Kit is wrong, we would rather put it right first: say which you want.

What you do

Email hello@familyhandoverkit.com from the address your Kit was sent to, or quote that address, within the 30 days. Or write to 128 Blindmans Lane, Cheshunt, Waltham Cross EN8 9DN, United Kingdom. Say "refund" or say what is wrong.

What happens next

We confirm by email and start the refund to your card within five business days. Your card issuer then takes its own time to show it; that part is outside our hands, so we do not promise a date for it.

How long it lasts

30 days from the day the Kit is emailed.

What it costs you

Nothing. If you spend anything to make a claim, tell us in the same email or letter and we repay it.

Your other rights

The benefits this promise gives you are in addition to other rights and remedies you have under the law in relation to the Kit. It never replaces or shortens them.

After you buy

The Kit you receive is the one prepared on the day, and we do not replace it with different content afterwards. If you ask us to send it again within 12 months, it is prepared again from your stored answers, with the general information current on that day, and its record page says so.

Your answers

We keep your answers for 12 months after delivery so the Kit can be sent again if you ask, then delete them from our store. Answers from an order that was never paid for are deleted after 30 days. The delivery email carries a link that deletes them from our store sooner.

What we collect, who handles it and where, and what each provider keeps after a deletion and for how long, is in the privacy notice: familyhandoverkit.com/au/privacy

If something goes wrong

Email us first; most things are put right by return. If we cannot sort it out, you can contact the consumer protection agency in your state (NSW Fair Trading, Consumer Affairs Victoria, or the Queensland Office of Fair Trading) or report the matter to the Australian Competition and Consumer Commission at accc.gov.au.

Changes to these terms

We may change these terms for future sales. The terms that apply to your purchase are the ones dated at the top of this page and shown when you bought.

Every version stays published, unchanged, at its own dated address, listed at the foot of this page, and your order records the version you accepted.
